TERMS AND CONDITIONS

Please carefully read the following terms and conditions regarding your participation in Joey Wright’s Swimwear Photography Workshop (hereinafter referred to as “Workshop”) conducted by Joey Wright Photo LLC (hereinafter referred to as the “Host”) in Miami, Florida (hereinafter referred to as the “Site”).

By registering for the Workshop online and submitting payment, you (hereinafter referred to as the “Attendee”) signify your acceptance of and obligation to these terms and conditions. If you have objections to the conditions outlined below, please contact info@joeywrightevents.com, and we’ll be happy to assist.

ATTENDEE CONDUCT
Host reserves the right to ask Attendee to leave the Site and Workshop immediately if deemed inappropriate, uncooperative, intoxicated, in possession of any illegal substance, or a safety risk to others. In such case, the Attendee’s tuition for the Workshop will not be reimbursed under any circumstances and they will not receive any future services or communications from Host. Attendee will also not receive any of our advertised bonuses, guarantees, or any other written or implied services.

LIABILITY WAIVER
While we take every possible measure to ensure Attendee safety at the Workshop, we cannot control everything. For this reason, every Attendee is legally responsible for their own safety, health, behavior, results, and possessions and agrees to – and is held legally liable to – release Host from all liability. Attendee hereby agrees to the following statements:

“I, the willing Attendee of the Workshop, hereby accept all risk to my health, property and of my injury or death that may result from participating in the Workshop and I hereby release Host, Joey Wright, the Site, and their officers, employees, interns, contractors, sponsors, and representatives from any and all liability to me, my personal representatives, estate, heirs, next of kin and assigns for any and all claims and causes of action for loss of or damage to my property and for any and all illness or injury to my person, including my death, that may result from or occur during my participation at the Workshop, whether caused by the negligence of the Host, its owner, or representatives, or otherwise. I further agree to indemnify and hold harmless Host and any third-party company from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while attending and participating in the Workshop. Under no circumstances will Host or Joey Wright be held liable for my injury or death or any loss or damage of my personal belongings due to my participation in the Workshop. Should I require emergency medical treatment as a result of an accident or illness arising during my attendance and participation at the Workshop, I consent to such treatment. I acknowledge, and I agree to be financially responsible for any medical or legal bills that may be incurred as a result of emergency medical treatment. I will notify the Host verbally and in writing if I am at any time injured prior to, during, or after the Workshop in my travels or attendance, or if I have medical conditions about which emergency medical personnel should be informed; however, I understand that Host is not legally obligated to act on that information in any way or to provide any medical service whatsoever to me. I agree that if I have any medical or psychological conditions that may hamper me from fully and healthfully participating in the Workshop I will notify the Host and that the Host retains the right to ask that I not participate in portions and/or the entirety of the Workshop.”

LIABILITY WAIVER: NO PROFESSIONAL ADVICE
The information contained in or made available through Host’s Workshop, websites, or services cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, mental, financial, medical, psychological, sales, or legal fields. Host does not offer any professional, medical, financial, or legal advice and none of the information contained in the Workshop should be confused with such advice. Neither Host nor its sponsors, speakers, partners, contractors, or any of their affiliates will be liable for any direct, indirect, consequential, special, exemplary or other damages, including economic loss, that may result from the use of, or the inability to use, the materials, information or strategies communicated through the Workshop, or any products or services provided before or after the Workshop, even if advised of the possibility of such damages.

NO RECORDINGS AND AUDIO/VISUAL RELEASE
Attendee understands that he/she may not record in audio or video, in any form or for any duration, the information presented at the Workshop. Attendee also understands that the Host will document the Workshop using video and/or photography. Attendee agrees that the Host and its assigns have the right and permission to use such photographs and recordings should they include the Attendee’s name, likeness, voice, city/state of residence, photograph, or appearance on video for advertising or any other purpose in any media or format, online and/or offline, now or hereafter without further compensation, permission or notification. Attendee understands that all recordings from the Workshop are the exclusive rights of the Host and does not ask for or expect compensation or notification of the use of recordings or photographs in which he/she appears or speaks.

CONFIDENTIALITY AND NON-COMPETE
Attendee hereby understands that the tools, stories, concepts, strategies, materials, and information presented in the Workshop are confidential, copyrighted, and proprietary to the Host and agrees not to record, duplicate, distribute, teach, or train from the Workshop materials and information in any manner whatsoever without the express written permission of the Host. Any unauthorized use or distribution of these proprietary concepts, materials, and intellectual property by the Attendee or their representatives is strictly and legally prohibited. Host will pursue legal action and seek full damages if these terms are violated to protect its rights.

SATISFACTION POLICY
If the Attendee is not satisfied at the conclusion of the event and he/she notifies the Host as described herein, Host may refund some or all of the Attendee’s tuition. Any Attendee who is not satisfied must, at the immediate conclusion of the Workshop, notify the Host’s staff in writing of his/her dissatisfaction. Host may then arrange for a tuition reimbursement within 15 days, with the amount solely decided by the Host. All reimbursements are at the sole discretion of the Host and all Host decisions are final and binding. Attendee may be asked to submit a letter outlining his/her dissatisfaction prior to reimbursement, as well as to turn in his/her course materials at the conclusion of the Workshop. Any statements of dissatisfaction or requests for refunds received after 24 hours following the conclusion of the Workshop will not qualify for this guarantee. Reimbursement, partial or full, will not be made to Attendee if Attendee leaves the Workshop early for any reason.

NO REFUND POLICY FOR REGISTRATIONS
Once paid, registration fees, including partial payments or deposits, are non-refundable. Attendees may transfer their seat to another individual and must notify the Host while showing proof of the transfer in order for the new attendee to be properly registered. Please reach out to us at info@joeywrightevents.com if you need help finding a replacement for your spot in the event of a cancellation. Although we cannot guarantee a replacement attendee, we create a standby list once registration is full to help with this process.

DEPOSIT
If the remaining payment is not made 15 days prior to the start of the Workshop, Attendee understands that his/her seat will be released and the deposit held. The remaining payment will be taken automatically 30 days after the first payment was made using Attendee’s credit/debit card information provided at initial payment. If Attendee misses the second payment deadline (15 days prior to event start date), Attendee may still make final payment and reserve his/her seat up until the day of the Workshop so long as the seat has not been sold to another student. IMAGE USAGE
Attendee agrees that his/her images captured at the Workshop may be used for portfolio and self-promotional use only. Examples of portfolio use include personal photography websites and/or social media, including but not limited to: Facebook, Instagram, Pinterest, Twitter, 500px, and Flickr. Images may not be used commercially, made available for sale or profit, or made available to any online or print publication without the sole and express written permission of the model. While Host will not enforce the following request, it is recommended that Attendee include proper credit (including the name of the model, hair and makeup artist, and swimsuit brand) to their images when posted on social media.

MISCELLANEOUS
These terms will be governed by and construed in accordance with the laws of the State of Florida, without regard to any principles of conflicts of law. Host agrees to try mediation using a mediator of the Host’s choice. If mediation is not used, Attendee agrees that any action at law or in equity arising out of or related to these terms will be subject to binding arbitration in accordance with the American Arbitration Association and will be arbitrated in Florida. This is the entire agreement of terms and conditions between Attendee and Host relating to the subject matter it contains. The terms and policies, including updates, are available on the Workshop website.

SEVERABILITY
Should any provision of this agreement, or part thereof, be held invalid, the remaining provisions, or part thereof, shall remain in full force and effect.

AGREEMENT
By registering for the Workshop, the Attendee agrees to the terms detailed in this Workshop Liability Release and Terms of Attendance.
